WhyMe Terms of Use

WhyMe is a digital organization and self-expression tool that allows users to:

• Register with email and password.
• Confirm email and sign in through Supabase Auth.
• Recover a password through a recovery email.
• Create a profile and customize an avatar.
• Create and edit satellites, whys, or reasons.
• Configure local reminders.
• Delete an account in the app or through the web page.
• Purchase Premium access through a one-time Google Play purchase.
• WhyMe provides technology and structure. Users decide what information to enter, how to interpret it, and how to use it. No personal, emotional, professional, financial, or other result is guaranteed.

WhyMe is intended only for persons aged 18 or older who can legally agree to these Terms. By registering, the user represents that this requirement is met.

• Provide a valid email and maintain access to it.
• Protect account credentials.
• Not share, sell, or transfer the account.
• Report unauthorized access.
• Keep relevant information current.
• Be responsible for account activity, except where an incident is attributable to Derby Wife.
• Password recovery is managed by Supabase Auth; the recovery link may expire. Derby Wife does not have access to readable passwords and will never request passwords by email.

• The truthfulness and legality of submitted information.
• Decisions made using the app.
• Their interpretation of satellites, whys, reminders, or visual elements.
• Content shared outside the app.
• Obtaining permission before including another person's data or image.
• Keeping their own copy of information they consider essential.
• Users should not enter passwords, banking data, official documents, medical records, or third-party sensitive information without authorization.

WhyMe does not provide medical, psychological, psychiatric, therapeutic, legal, financial, employment, educational, or emergency services. No text, reminder, design, or content is a diagnosis, treatment, professional recommendation, or instruction to act. WhyMe does not monitor emergencies and cannot contact emergency services.

• Use WhyMe to violate law or third-party rights.
• Submit unlawful, threatening, abusive, defamatory, discriminatory, or harmful content.
• Upload third-party data or images without authorization.
• Access another account, server, or data.
• Bypass security, limits, or purchase controls.
• Reverse engineer, decompile, or extract code except where expressly permitted by law.
• Use bots, scraping, abusive automation, or unauthorized load testing.
• Distribute malware or interfere with operation.
• Copy, resell, or commercially exploit WhyMe or its assets without permission.
• Use the app to harass, surveil, or profile another person.
• Impersonate Derby Wife or claim an unauthorized relationship.

Users retain their rights in original content. To operate WhyMe, users grant Derby Wife a limited, worldwide, non-exclusive, royalty-free license solely to host, technically reproduce, process, back up, synchronize, and display that content to the user and perform requested functions. The license ends when content or the account is deleted, subject to temporary backups and lawful retention. Derby Wife does not acquire ownership of user goals, reasons, images, or text.

The Anthropic AI or reflection feature is not enabled in this release. No user content is currently sent to Anthropic. If enabled in the future, the relevant conditions, risks, and data processing will be disclosed in advance.

WhyMe may offer free and Premium features, including additional customization options, pieces, backgrounds, accessories, effects, or other in-app improvements. Feature availability may change for technical, legal, or platform reasons. Changes will not override mandatory consumer rights or improperly impair a valid purchase.

WhyMe Premium is a one-time, non-consumable purchase. It is not a subscription, does not automatically renew, and does not create recurring charges. The Google Play product is whyme_premium_lifetime. The user acknowledges that:

• Payment is processed by Google Play Billing.
• Price, currency, taxes, and payment methods are displayed and administered by Google Play.
• WhyMe does not receive the full card number, CVV, PIN, or banking credentials.
• RevenueCat receives and processes purchase information to validate and restore Premium access.
• The technical source of Premium access is CustomerInfo.entitlements.active.premium.
• Access may become inactive if Google Play revokes, refunds, or invalidates the purchase, or if fraud or association errors occur.

Users may use the Restore Purchase feature in WhyMe. Restoration attempts to synchronize the purchase from Google Play and update RevenueCat status. It normally requires the same Google Play account used for the original purchase and may depend on store availability, RevenueCat availability, and user association or transfer settings. Restoration does not guarantee recovery of a purchase that was refunded, revoked, invalidated, or made with a different Google Play account.

Refunds, when available, are governed by Google Play and mandatory consumer rights. Derby Wife may provide guidance but does not control every Google refund decision. Deleting the app, signing out, or deleting a WhyMe account:

• Is not a request for or grant of a refund.
• Does not necessarily erase Google Play transaction history.
• Does not erase records Google must retain under its policies.
• May remove the current RevenueCat account association; a user who creates a new account must attempt Restore Purchase.

WhyMe, Derby Wife, software, interfaces, avatar catalog, illustrations, effects, original text, logos, marks, and other materials belong to Michel Pierre Suárez Medel or are used under license. Users receive a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the app under these Terms. Users may not extract assets, resell designs, create a derivative app, use marks confusingly, or remove proprietary notices.

WhyMe relies on third-party services including Supabase, Google Play, RevenueCat, and Expo/EAS. Provider outages, changes, or decisions may affect functionality. Anthropic is not an active provider for user content in this release. Users are also subject to the terms of services they contract with directly, such as Google Play.

We may fix errors and vulnerabilities, modify interfaces or features, apply permitted updates, temporarily suspend service for maintenance or security, and remove unlawful, unsafe, infeasible, or third-party-dependent features. We do not guarantee uninterrupted availability, permanent compatibility with every device, or complete absence of errors. We will use reasonable measures to protect continuity and data.

We may suspend or terminate access for serious or repeated violations of these Terms; fraud, abuse, security risks, or unauthorized access attempts; authority or platform requirements; or protection of users, third parties, or the service. Where reasonable, we will notify the user and allow clarification. Suspension does not remove non-waivable rights or itself create a refund.

Deletion may be initiated through Settings > Account > Delete account, or at https://www.derbywife.com/whyme/account-deletion. Deletion is irreversible once completed; users should first preserve any information they wish to keep. The Supabase Auth account, profile, avatar, satellites, whys, reminders, existing images or memories, preferences, sessions, and associated data will be deleted or de-identified, subject to minimum legitimate retention. The identifiable RevenueCat customer record must be deleted or de-identified unless temporary retention is required by law, security, fraud prevention, purchase handling, dispute resolution, or legal defense. Google Play may retain purchase history under its own policies.

To the fullest extent permitted by law, WhyMe is provided “as is” and “as available.” We do not guarantee:

• Satisfaction of subjective expectations.
• Improvement in wellbeing, relationships, productivity, or results.
• That data will never be lost, although reasonable measures are used.
• Compatibility with every configuration, device, or future version.
• Unchanged third-party services.
• Mandatory warranties and non-waivable rights remain unaffected.

To the fullest extent permitted by applicable law: Derby Wife and Michel Pierre Suárez Medel are not responsible for decisions, conduct, publication, interpretation, or use by a user based on WhyMe; nor for user-submitted content, unauthorized third-party data, credential sharing, or content exported outside the app; nor for indirect, incidental, special, punitive, or consequential damages, or loss of opportunity, reputation, revenue, data, or profits, where lawful.

Total aggregate liability related to WhyMe will not exceed the amount actually paid by the user for WhyMe; for the one-time Premium purchase, it will not exceed that purchase amount. If no payment was made, liability is limited to the minimum amount, if any, mandatorily required by law. These limitations do not apply where prohibited, including fraud, willful misconduct, gross negligence, legally non-excludable personal injury, or non-waivable consumer or data-protection rights.

There is no liability for delay or failure caused by events beyond reasonable control, including general telecommunications failures, authority actions, disasters, large-scale attacks, provider outages, or mandatory platform changes, without prejudice to obligations that must legally be performed.

Invalid provisions will be limited or severed to the minimum extent necessary, and the remaining provisions continue. Failure to enforce a right is not a waiver. Users may not transfer accounts or these Terms without authorization. Derby Wife may reorganize operations or transfer the service to a lawful successor, subject to the Privacy Policy and required notice. These Terms, the Privacy Policy, and the conditions displayed by Google Play form the applicable agreement.

These Terms are governed by the federal laws of Mexico without depriving users of mandatory protections in their place of residence. Before litigation, the parties should attempt in good faith to resolve a dispute through support@derbywife.com for at least thirty calendar days, unless urgent relief, limitation periods, or direct recourse to an authority applies. Users may contact the Federal Consumer Protection Agency (PROFECO), the Secretaría Anticorrupción y Buen Gobierno, and competent courts. Where legally valid and no mandatory jurisdiction applies, disputes may be submitted to the competent courts of Mexico City, Mexico.
